ZERO TOLERANCE LEGAL NOTICE
Every driver has the responsibility to drive safely and follow the established rules of the road. This zero-tolerance drug and alcohol policy is designed for drivers during their provision of services to Ride Luma LLC. This policy ensures a safe, healthy, and drug-free work environment for all drivers, passengers, and the public. It applies to all drivers and riders performing and/or receiving services for/from Ride Luma LLC.
CLAUSE ONE – Prohibited Conduct
Drivers are strictly prohibited from:
Reporting for Duty Under the Influence: reporting for or remaining on duty while having an alcohol concentration of 0.02 or greater
On-Duty Use: consuming alcohol or using illegal drugs while performing services for Ride Luma LLC
Pre-Duty Use: Consuming alcohol within four (4( hours prior to performing services for Ride Luma LLC
Post-Accident Use: Consuming alcohol for eight (8) hours following an accident, or until a post-accident test is completed
Possession: possessing alcohol or controlled substances while performing services for Ride Luma LLC
Illegal Drug Use: using any prohibited drug, including marijuana (even where legal under state law), cocaine, opioids, amphetamines, and PCP
CLAUSE TWO – Prescription Medication and Testing Requirements
The use of legally prescribed medication if permitted only if a medical professional has advised the driver that the substance will not adversely affect their ability to safely operate a vehicle. Drivers must notify Ride Luma LLC, in writing, of any medications that carries a warning label regarding mental or motor impairment.
Drivers and subject, but not limited to the following tests:
Pre-Employment: all applicants must pass a drug test with a verified negative result before performing services
Random: conducted on an unannounced, ongoing basis throughout the year
Reasonable Suspicion: triggered by specific, contemporaneous observations of appearance, behavior, or speech
Post-Accident: required following accidents involving loss of life, injury requiring immediate medical treatment, or disabling vehicle damage
CLAUSE THREE – Consequences of Violations:
As Ride Luma LLC is a zero-tolerance company, the following actions may result in immediate termination and/or permanent contract cancellation:
A verified positive drug test
A confirmed alcohol concentration of 0.02 or higher
Refusal to test: this includes failing to appear for a test, failing to remain at the site until complete, or providing an adulterated/substituted specimen
CLAUSE FOUR – Reporting and Complaints
Passengers, and drivers are encouraged to report any suspected violations immediately.
A driver can always decline a trip for their own safety, including instances where a rider appears under the influence of drugs and/or alcohol.
A rider can ask the driver to stop the vehicle if the rider has a reason to believe the driver may be under the influence of drugs and/or alcohol. Exit the vehicle, call 911. Report the incident, in writing, directly to Ride Luma LLC at info@rideluma.com
Drivers are independent third-party providers and not actual agents or employees of Ride Luma LLC.
